The form of the employment contract in the draft of the Labour Code of Ukraine.

Abstract

This paper analyzes the rules of the draft of the Labour Code of Ukraine concerning the conclusion of an employment contract, including those relating to its shape. Based on the analysis of forms of employment contract, which are traditionally referred to as oral and written, there is the hollowness of this claim. The necessity of consideration of the form of the employment contract only as written is grounded. The new version of Article 41 is offered. "The form of the employment contract " project, which fixes the ways of expressing of the written form of the employment contract. This form, at the suggestion of the author, can be expressed in documents " employment contract" and by execution of documents: statements, orders, employment record. It is touched upon the problem of uncertainty in determining the outward expression of the written form of the employment contract, suggestions for improving of the project are offered. Also it was the current issues of practical application, particularly in the design of an employment contract, regulatory requirements of the laws that govern the electronic document in Ukraine
