Signs for commodities and services: legal nature and legal safeguard

Abstract

A sign for commodities and services is an important instrument in realization of commodities and assists defence of interests of not only producer but also consumer. In the article nature of right is considered on a sign for commodities and services of the relatively Ukrainian. For today a normativelylegal base through this question is sound enough. Integration processes what be going on in Ukraine predetermine the necessity of bringing a national legislation over in accordance with certain international standards on the settlement of relations in relation to the use of trademarks. Presently the legal adjusting of relations on the use of trademarks in the Ukrainian legislation on the whole corresponds to international practice. The legal safeguard of trade mark (sign for commodities and services) is considered. Drawn conclusion, that the feature of right of intellectual ownership on a sign for commodities and services is caused by the specific of this object. A trademark, and specific of him, comes forward such object, as well as other objects of right of intellectual ownership, shows up in immaterial character.
